About the only way Cheryl is ever going to be allowed to visit the USA again is if her business needs her to do so in a way that the US government understands. The US government clearly doesn't understand traveling to SF conventions and other conferences as unpaid hobby activities. So helping WTP get going will build up the business case that will justify investing a pretty substantial amount of money (think at least high four figures) in trying to get the US Government to admit they screwed up when they refused her entry.

Even if it's possible to prove that the ICE was wrong, the fact that they tossed her even though it wasn't her fault makes her permanently ineligible for VWP, so she must get a visa if she's ever going to be able to visit the USA ever again.
